1. Acceptance of Terms

Welcome to TrendX ("Platform", "we", "our", or "us"). By accessing, browsing, or using our website and services, you ("User" or "Customer") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use immediately.

These Terms constitute an electronic contract under the provisions of the Indian Information Technology Act, 2000, and the rules framed thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and conform to applicable international electronic commerce directives.

2. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to enter into this agreement and make online payments. If you are under 18, you may only use this Platform with the involvement and explicit consent of a parent or legal guardian.

3. Service Description & Delivery

TrendX provides an artificial intelligence-assisted digital creative tool that transforms uploaded personal portrait photographs into retro 1980s aesthetic images inspired by trending archival photography styles.

Delivery of Digital Service: Upon successful completion of the ₹10 transaction via our payment gateway (Razorpay), our studio immediately creates your custom 1980s retro photograph. Delivery occurs digitally directly in your browser within 15 to 60 seconds. The resulting high-resolution image is available for immediate download and saved securely to your personal device gallery.

4. Pricing, Payments & Refund Policy

Pricing: All transformations are priced at ₹10 (Indian Rupees Ten Only) per generation, inclusive of all applicable taxes unless otherwise stated. Payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway.

Refund & Cancellation Policy:

• Because the service provides instantaneous custom digital portrait creation, once an image generation is successfully completed and rendered, the transaction is considered finalized and non-refundable.
• Failed Generations: If a technical failure, server timeout, or gateway malfunction prevents the generation of your photo after successful debit of funds, you are entitled to a full refund or a complimentary regeneration token.
• Requesting a Refund: Please email our official support desk via Contact Us within 7 days of the transaction with your Razorpay Payment ID (e.g. pay_...). Legitimate refund claims are processed back to the original payment method within 5 to 7 business days per Reserve Bank of India (RBI) banking norms.

5. User Content & Intellectual Property

Ownership: You retain all preexisting ownership rights to the photos you upload. Subject to your compliance with these Terms, TrendX grants you a perpetual, worldwide, royalty-free license to use, reproduce, display, and share the AI-generated retro images for both personal and non-commercial social media purposes.

User Representations & Warranties: You explicitly represent and warrant that:

• You own or possess the necessary licenses, rights, and explicit consent of the individual(s) depicted in any uploaded photo.
• You will not upload photos of third parties without their express authorization.
• You will not upload images depicting minors without parental/guardian consent.

6. Acceptable Use & Prohibited Conduct

Under Section 67 and 67A of the Indian Information Technology Act, 2000, and international content safety regulations, you agree NOT to use TrendX to:

• Generate non-consensual deepfakes, sexually explicit, defamatory, obscene, or harassing imagery.
• Impersonate any living person, public official, or celebrity without lawful authorization.
• Upload content that infringes upon any copyright, trademark, privacy, or moral rights.
• Attempt to reverse-engineer, decompile, or launch automated scraping against the Platform APIs.

7. Disclaimers & Nature of AI Outputs

The outputs generated by TrendX are synthesized using probabilistic artificial intelligence models. While we utilize state-of-the-art vision locking algorithms to preserve subject identity, AI-generated imagery may display stylistic variations, background artifacts, or vintage distortions typical of 1980s analog media. All services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian and international law, TrendX and its operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the actual amount paid by you (i.e. ₹10 per incident).

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent civil courts located in India.
